These terms set out the deal between you and TOFFEHA when you browse, buy, or publish travel plans and services on our marketplace. Please read them. Using TOFFEHA means you accept them.
Last updated June 2026. A quick plain-language summary: TOFFEHA is a marketplace that connects travellers with local creators. We process payments and take a small commission. Creators own their work and are responsible for it. Buyers get a licence to use what they buy. We do our best, but travel is real life, so some things are out of our hands.
1. Acceptance of these terms
By creating an account, browsing, buying, or publishing on TOFFEHA ("the platform", "we", "us"), you agree to these Terms of Service and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the platform. If you use TOFFEHA on behalf of a business, you confirm you are authorised to bind that business to these terms.
2. Who we are
TOFFEHA is a travel-plan and services marketplace founded to help people discover, build, share, and sell real itineraries, with a special focus on putting Tunisia and the wider region on the map. We operate the website, the creator Studio, and the systems that connect travellers and local creators.
3. Our role as a marketplace
TOFFEHA is an intermediary. Creators list travel plans, guiding, transport, stays, experiences, and other services. Buyers purchase them. The contract for each plan or service is between the buyer and the creator who provides it. We are not the author, guide, host, driver, or agency, and we do not deliver the underlying travel services ourselves unless a listing clearly says it is provided by TOFFEHA.
We provide the storefront, discovery, messaging, payment processing, and dispute tooling. We are not a party to the travel itself and do not guarantee any creator, listing, price, availability, or outcome.
4. Your account
You must be at least 18 years old, or the age of majority where you live, to buy or sell on TOFFEHA. You agree to provide accurate information, keep your credentials secure, and take responsibility for everything that happens under your account. Tell us promptly if you suspect unauthorised use. You may hold a single account that can act as both a buyer and a creator.
5. Terms for creators
When you publish on TOFFEHA you confirm that your content is yours or that you have the rights to sell it, that it is accurate and not misleading, and that you can lawfully provide the service you advertise, including any licences, permits, or insurance required in your location. You set your prices within the platform's limits and you are responsible for delivering what you promised, on time and as described.
Each listing has one fulfilment type, for example a downloadable plan, a bookable service, a stay, a custom planning service, or a physical product. You are responsible for your own taxes, for honouring your stated cancellation terms, and for treating buyers fairly and professionally. We may review, rank, feature, hold, or remove listings to protect buyers and the integrity of the marketplace.
6. Terms for buyers
When you buy, you agree to the creator's listing description and their cancellation terms shown at checkout. Digital travel plans are delivered as files or online content for your personal, non-commercial use. Booked services, stays, and experiences are subject to the creator's availability and to local conditions. Please read each listing carefully and message the creator if anything is unclear before you buy.
7. Payments, fees and taxes
Payments are processed by our payment providers. TOFFEHA retains a commission and any applicable processing fees from each sale, and the creator receives the balance through their connected payout account, subject to holds, refunds, and chargebacks. Commission rates are shown to creators before they publish and may change with notice. Prices are displayed inclusive or exclusive of tax depending on your location and applicable law. You are responsible for any taxes that apply to your own activity.
8. Content, licence and ownership
Creators keep ownership of the content they upload. By publishing, you grant TOFFEHA a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, adapt for formatting, and promote your content in connection with operating and marketing the platform. When a buyer purchases a digital plan, they receive a limited, personal, non-transferable licence to use it for their own travel. Buyers may not resell, redistribute, or publish purchased content as their own.
9. Acceptable use
You agree not to use TOFFEHA to break the law, infringe anyone's rights, post false or harmful content, harass others, circumvent our fees by taking transactions off-platform, scrape or overload our systems, upload malware, or misrepresent who you are. We may investigate and act on suspected abuse, including removing content and suspending accounts.
10. Intellectual property
The TOFFEHA name, logo, mascot, design system, and software are owned by TOFFEHA and protected by intellectual property laws. Nothing in these terms transfers our rights to you. You may not copy, modify, or create derivative works of the platform itself without our written permission.
11. Disclaimers
The platform and all listings are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that listings are accurate, that creators will perform, that travel will be safe or enjoyable, or that the platform will be uninterrupted or error free. Travel carries inherent risks that are your responsibility to assess.
12. Limitation of liability
To the fullest extent permitted by law, TOFFEHA and its founders, team, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or travel disruption, arising from your use of the platform or any listing. Our total liability for any claim relating to the platform will not exceed the greater of the commission we actually earned on the transaction in question or fifty US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnity
You agree to defend, indemnify, and hold TOFFEHA harmless from claims, damages, and costs, including reasonable legal fees, arising from your content, your listings, your use of the platform, your breach of these terms, or your violation of any law or third-party right.
14. Suspension and termination
You may close your account at any time. We may suspend or terminate access, remove content, or withhold payouts if we reasonably believe you have breached these terms, created risk for buyers or the platform, or where required by law. Provisions that by their nature should survive termination, including payment obligations, licences you granted, disclaimers, limitation of liability, and indemnity, will continue to apply.
15. Governing law and disputes
These terms are governed by the laws of Tunisia, without regard to conflict-of-law rules, unless a mandatory consumer-protection law in your country of residence provides otherwise. We encourage you to contact us first so we can try to resolve any issue informally. Where a dispute cannot be resolved, it will be handled by the competent courts of Tunis, unless local law requires a different forum for you as a consumer.
16. Changes to these terms
We may update these terms as the platform evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continuing to use TOFFEHA after changes take effect means you accept the revised terms.
